Terms of Service

By accessing or using IMG II AMC ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not accept these Terms in their entirety, you may not access or use the Platform. We reserve the right to update or modify these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms. The date of the most recent revision is indicated at the top and bottom of this document.

IMG II AMC is a commercial educational service providing clinical examination preparation materials for international medical graduates. The Platform is not affiliated with the Australian Medical Council (AMC) or any medical licensing authority, educational institution, or government body. All content is developed independently and is intended solely for educational and examination preparation purposes.

The content provided on this Platform is strictly for educational and examination preparation purposes. It does not constitute professional medical advice, clinical guidance, or a substitute for independent clinical judgement. Content must not be used for clinical decision-making or patient care. You acknowledge that clinical medicine evolves and that while we endeavour to align content with current Australian guidelines, no guarantee is made as to the completeness or currency of any individual question, explanation, or reference.

You must provide accurate, complete, and verifiable identity information when creating an account. Each account is for a single individual. You may not create more than one account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorised use of your account.

Upon payment of the applicable subscription fee and subject to your compliance with these Terms, IMG II AMC grants you a non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform content for your personal educational use only. This licence is limited to the duration of your active subscription period. You do not acquire any ownership rights in the content.

All prices are listed in Australian Dollars (AUD). Subscriptions are available in fixed-term tiers. All subscriptions are billed once at the time of purchase. There are no automatic renewals, no recurring charges, and no hidden fees. When your subscription period ends, access to the question bank ceases. You will receive a notification prior to expiry with the option to renew manually. Payment is processed through a secure, PCI Level 1 certified provider. Your card details are never stored on our servers.

Due to the nature of digital content, all sales are final. Once a subscription is activated and access to the Platform content is granted, refunds are not available under any circumstances. We encourage you to review the Platform features, FAQ, and available information thoroughly before subscribing. It is your responsibility to ensure that your device and internet connection meet the requirements for using the Platform prior to purchase.

Your performance data (including question history, scores, and analytics) is retained for 90 days following the expiry of your subscription. If you resubscribe within that period, your data is restored and you resume where you left off. After 90 days without an active subscription, performance data is permanently and irreversibly deleted.

All content on the Platform, including but not limited to questions, explanations, clinical vignettes, images, code, design elements, and branding, is the exclusive intellectual property of IMG II AMC and is protected by copyright. No reproduction, distribution, modification, or derivative use of any Platform content is permitted, whether in whole or in part, by any means. Any unauthorised use constitutes a violation of these Terms and applicable copyright law.

The Platform employs technical measures to protect its intellectual property. These include, but are not limited to, restriction of browser functions on content areas, session monitoring, activity logging, and visible digital watermarking. When accessing protected content, your registered name and a unique account identifier are displayed as a watermark on screen. This information is linked to your account and may be used to identify the source of any unauthorised reproduction or distribution of Platform content.

The Platform enforces a one active session per account policy. If your account is accessed from a second device while an existing session is active, the first session will be terminated automatically. This is a security and anti-sharing measure. If you believe your account has been accessed without your authorisation, contact us immediately.

You agree not to: share, sell, rent, lease, sublicense, or otherwise transfer your account credentials or access to any other person; use any automated tool, script, bot, or scraping mechanism to access or extract content from the Platform; attempt to circumvent, disable, or interfere with any content protection, authentication, or security feature of the Platform; capture, record, photograph, or reproduce any Platform content by any means, including but not limited to screenshots, screen recording, or external capture devices; use the Platform content to develop, contribute to, or distribute any competing product or service; or engage in any activity that violates applicable laws or regulations.

We reserve the right to suspend or terminate your account and access to the Platform, without prior notice and without refund, if we determine at our sole discretion that you have breached any provision of these Terms. This includes, but is not limited to, evidence of account sharing, content reproduction, use of scraping tools, or any attempt to circumvent content protection measures. We reserve the right to pursue all remedies available by law and in equity for such breaches.

To the maximum extent permitted by law, IMG II AMC shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Platform, including but not limited to loss of data, loss of revenue, examination failure, or interruption of study. Our total aggregate liability arising out of or relating to your use of the Platform shall not exceed the amount you paid for your current subscription period.

The Platform and its content are provided on an "as is" and "as available" basis. IMG II AMC makes no warranties, express or implied, regarding the Platform, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. You bear sole responsibility for your research and decisions regarding the purchase and use of the Platform.

You agree to indemnify, defend, and hold harmless IMG II AMC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

By using the Platform, you consent to the collection and use of your information as described in this section. We collect the following personal information: your name, email address, country of medical graduation, and payment transaction records. This information is collected during account registration and the subscription process. Your personal information is stored on encrypted servers. Authentication is handled through secure protocols. We do not share, sell, or distribute your personal information to third parties. Payment is processed through a secure, PCI Level 1 certified provider. Your card details are never stored on our servers. We collect usage data including question responses, scores, session duration, and performance analytics to provide the dashboard and tracking features of the Platform. This data is associated with your account and retained in accordance with the data retention policy described in Section 8. The Platform uses cookies and local storage for authentication and session management only. We do not use tracking cookies for advertising or third-party analytics. You may request deletion of your account and associated personal data by contacting support@img2amc.com. Account deletion is permanent and irreversible.

Certain features of the Platform allow you to create and store content associated with your account, including personal study notes and error reports on questions ("User Content"). User Content is stored on our servers and is associated with your account for the duration of your subscription and any applicable retention period. You retain ownership of User Content you create. By submitting User Content, you grant IMG II AMC a non-exclusive, royalty-free licence to store, process, and use your User Content for the purposes of operating, maintaining, and improving the Platform, including quality assurance and platform improvement activities. IMG II AMC may review User Content to ensure the quality and accuracy of question bank content, to investigate reported errors, and to improve the Platform. User Content is subject to the data retention policy described in Section 8. You are solely responsible for the content of any User Content you submit. You agree not to submit User Content that is unlawful, defamatory, harassing, or otherwise objectionable.

These Terms are governed by applicable law. By using the Platform, you submit to the jurisdiction of the courts in the territory in which IMG II AMC operates.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

These Terms constitute the entire agreement between you and IMG II AMC regarding your use of the Platform. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein. No statement, representation, or promise made outside of these Terms shall be binding.
